Welcome to Abuelitos Tequila. These Terms of Use (“Terms”) govern your access to and use of abuelitostequila.com and any related properties (the “Site”), operated by Abuelitos Tequila, LLC (“Abuelitos,” “we,” “our,” or “us”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.
The Site is intended solely for individuals who are of legal drinking age in the jurisdiction in which they reside or access the Site. By using the Site, you represent and warrant that (a) you are at least twenty-one (21) years of age, or the legal drinking age in your jurisdiction, whichever is older; (b) you have the legal capacity to enter into this agreement; and (c) you may lawfully purchase and consume alcoholic beverages where you reside. We market our products only to individuals of legal drinking age. If we learn that any person below the legal age has accessed or attempted to use the Site, we reserve the right to terminate access immediately.
Abuelitos Tequila supports the responsible enjoyment of our products. Tequila and other alcoholic beverages should be consumed in moderation by adults of legal drinking age. Never drink and drive. You may access and use the Site for lawful, personal, non-commercial purposes only. You agree not to:
Reproduce, distribute, modify, or create derivative works of any Site content without our prior written consent;
Use any robot, spider, scraper, or other automated means to access the Site;
Attempt to gain unauthorized access to any portion of the Site, accounts, systems, or networks;
Use the Site in any manner that could disable, overburden, or impair its operation;
Submit content that promotes or glamorizes underage drinking, drunk driving, or excessive consumption.
All content on the Site — including text, graphics, logos, icons, images, photographs, video, audio, and software — is the property of Abuelitos Tequila, LLC or its licensors and is protected by U.S. and international copyright, trademark, and other intellectual-property laws. The “Abuelitos Tequila” name, logo, “Drink to Remember,” and all related marks are trademarks of Abuelitos Tequila, LLC. You may not use these marks without our prior written permission.
If you submit, post, or transmit any content to the Site (including via contact forms, contests, or social-media interactions tagged with our brand) — such content is referred to as “User Content.” By submitting User Content, you grant Abuelitos Tequila a perpetual, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, and display such content for any purpose, including marketing and promotional use. You represent that your User Content does not violate any third-party rights and complies with applicable law and these Terms.
The Site may contain links to third-party websites, including our retail partners and social-media platforms. These links are provided for your convenience. We do not control, endorse, or assume responsibility for the content, privacy practices, or terms of any third-party site. Your use of any third-party site is at your own risk and subject to the terms and policies of that site.
Product descriptions, pricing, and availability on the Site are subject to change without notice. We reserve the right to limit quantities, refuse orders, or discontinue products at any time. In the event of a pricing or descriptive error, we reserve the right to cancel any orders placed at the incorrect price and issue a full refund. Orders for alcoholic beverages are fulfilled by licensed retailers and shipped only to jurisdictions where the sale and delivery of distilled spirits is permitted. A signature from an adult of legal drinking age is required at delivery.
From time to time we may offer contests, sweepstakes, or promotions through the Site or our social-media channels. Each promotion will be governed by its own official rules, which take precedence over these Terms in case of conflict. Promotions are open only to individuals who meet the legal drinking age requirement in their jurisdiction.
THE SITE AND ALL CONTENT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ABUELITOS TEQUILA DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT ANY DEFECTS WILL BE CORRECTED. YOUR USE OF THE SITE IS AT YOUR SOLE RISK.
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL ABUELITOS TEQUILA, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SITE OR OUR PRODUCTS, WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
You agree to defend, indemnify, and hold harmless Abuelitos Tequila and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with (a) your access to or use of the Site, (b) your violation of these Terms, or (c) your User Content.
These Terms are governed by the laws of the State of Nevada, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the Site shall be resolved through binding arbitration in Clark County, Nevada, under the rules of the American Arbitration Association. You waive any right to participate in a class action. This arbitration provision does not apply to claims to enforce, protect, or concerning the validity of intellectual-property rights, which may be brought in court.
We may revise these Terms from time to time. The “Effective Date” at the top of this page indicates when the most recent changes were made. Continued use of the Site after revisions become effective constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
If any provision of these Terms is found unenforceable, that provision shall be limited or severed and the remaining provisions shall remain in full force. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
